Disputes with People or Businesses that are Overseas
Legal disputes are a fact of life for any business. When they happen, you need a legal team with the experience and expertise to handle them, so you can focus on running your business.
Complex disputes often require creative solutions. Our focus is on achieving a cost-effective solution that works for you commercially. Our Dispute Resolution team delivers high quality, practical advice quickly to help achieve the best outcome for you. From our initial meeting with you, through all steps in the dispute resolution process, your commercial objectives will always be at the heart of what we do.
As an Aaron & Partners client, you’ll enjoy the confidence of knowing you have a team behind you with experience and technical expertise that will fight to achieve your objectives. For the right cases we are able to offer fee options which include not paying us unless we achieve an agreed outcome or us taking a share of the proceeds of the claim, sharing the risk with you.
We are experienced in all kinds of dispute resolution processes including court proceedings, arbitration, adjudication and mediation. We regularly act for businesses in the UK with operations overseas that require assistance in relation to disputes with suppliers, customers or business partners overseas.
Some disputes have to be handled by the courts and under the law of the place where the other party to the dispute is based. We can assist in determining this and if the conclusion is that the dispute needs to be handled overseas then through our network of international connections we can put you in touch with the right overseas lawyer for the job. We can work as a team with the overseas lawyers to ensure you have all the information you need and an understanding of the options.
Sometimes, if you have a dispute with an overseas party it can still be handled under English law and in the English Courts. This requires advice about how the overseas party is served with any proceedings and, if you obtain a favourable result and the defendant’s assets are abroad, we can liaise with appropriate overseas lawyers to enforce the judgment or settlement agreement.
Work Examples Include:
- Acting in an International arbitration against an overseas government.
- Advising in relation to a potential shareholder dispute concerning a UK parent company with a continental European subsidiary and where some shareholders were resident overseas.
