Our Offices

The Legal Aid, Sentencing and Punishment of Offenders Act 2012 (LASPO) came into force on 1 April 2013. The Government’s intention was that LASPO would, by banning referral fees in personal injury cases, reduce the so-called “compensation culture” and reduce the number of low value personal injury claims.

Our specialist team has an in-depth working knowledge of LASPO, ensuring you receive expert guidance on all matters of LASPO compliance.

Agreements we have drafted between law firms and CMCs have been reviewed by the SRA and the MOJ are judged not to be in breach of LASPO.

The same legislation brought into force new rules around funding agreements (Conditional Fee Agreements (CFA) and Damages-Based Agreements). We have advised numerous law firms and CMC’s on the effects of these changes and drafted appropriate funding agreements for their businesses.

Our team includes a partner who has undertaken specialist legal costs ADR training and who offers mediation and arbitration to law firms and their commercial clients on fee disputes and who is on the panel of the leading Costs dispute resolution service in London.

Comply with LASPO legislation

With our expertise across this entire field of law, we have helped many CMCs and PI practices with a wide range of issues.

Areas of Expertise:
  • Compliance with LASPO
  • Funding new market initiatives
  • Responding to SRA and MOJ enquiries
  • Restructuring commercial relationships to comply with LASPO
  • Reviewing current agreements and working methods
  • Understanding how the prohibitions imposed by LASPO are interpreted by the SRA (Solicitors Regulation Authority) and MOJ (Ministry of Justice)

Make LASPO work for you

With our assistance, you can be confident you’re complying with the requirements of LASPO when you, for example:

  • Develop joint marketing schemes for groups of law firms
  • Establish new businesses
  • Obtain authorisation from the claims management regulators at MOJ or the SRA
  • Prepare commercial agreements
  • Set up an ABS (Alternative Business Structure)

We have a long-established reputation for helping law firms, solicitors, barristers and their chambers and claims management companies carry out work relating to the referral fee prohibitions set out in the Act and the options to restructure businesses and marketing activities after 1 April 2013. In addition, we’re able to provide professional advice on damages-based agreements and funding issues.
