What are the benefits of using a Restructuring and Insolvency solicitor?

Whether you are a director of a company, or you are an office holder who requires advice as to strategy, seeking advice from a restructuring and insolvency solicitor can be pivotal for the following reasons:

When a company is facing insolvency, time is of the essence and so it is important that you seek advice early. Whether you require us to liaise with your creditors or provide you with advice in respect of your duties and responsibilities as directors, members and boards, our restructuring and insolvency team offer practical knowledge to ensure the best possible outcome, considering the commercial reality of the position, and ensuring that you feel at ease every step of the way.

We explore alternative routes

Liquidation isn’t the only solution. If your company is facing insolvency, you may feel that the only option is to wind the company up. However, from experience we have found that liquidation isn’t always the answer. Our team can work with you to find the most appropriate insolvency process for your company, analysing an effective strategy and assisting you throughout.

We work closely with insolvency practitioners

Our solicitors are highly experienced in working with licensed insolvency practitioners (IPs) advising them on their appointment and strategy throughout insolvency processes in which they have been appointed. We provide IPs with comprehensive advice and guidance to ensure full compliance of their statutory and regulatory duties with an aim to maximise recoveries to the insolvency estate for the benefit of creditors.

I own a business facing insolvency, what should I do?

We recognise that the prospect of company insolvency can be a stressful and overwhelming experience for a company’s directors and shareholders. Our team takes all the necessary steps to ensure that the process runs as smoothly as possible.

There are various options open to companies approaching insolvency, however the appropriate steps will depend on how far down the route of insolvency the business is. Our advice is tailored on a case-by-case basis.

Can you help me put a business into Administration?

Placing a business into Administration can be a complicated and lengthy process and is dependent on its specific circumstances.

A company can be placed into administration by way of the following:

  • A floating Charge Holder can appoint an Administrator;
  • A court order made upon a formal application to court; or
  • The Directors/Shareholders can appoint an Administrator

Our Restructuring and Insolvency team can assist you and the appointed administrator with the administration process from beginning to end.
