Dispute Resolution

We are experienced in all kinds of dispute resolution processes including court proceedings, arbitration, adjudication and mediation. We act for businesses in the UK with operations overseas that require assistance in relation to disputes with suppliers, customers or business partners overseas  and for overseas businesses who have operations in England and Wales who have disputes with distributors, joint venture partners, customers or suppliers in this jurisdiction. If you are an overseas business in dispute with a business or person in England and Wales we can help. The first thing we will do is assess whether the dispute is subject to English law and the jurisdiction of the English Courts. The types of dispute we can assist with include:

Shareholder or partnership disputes; disputes with distributors, agents or franchisees; property based disputes; customers who fail to pay; suppliers who supply sub standard gods or services or who don’t deliver on time; disputes in relation to your intellectual property; disputes in relation to mergers and acquisitions such as warranty claims; professional negligence claims against previous advisers in England or Wales. Where appropriate we can assist in seeking urgent relief including injunctions.

We also assist in enforcing judgments obtained overseas against the defendant’s assets in England and Wales.

We can act as part of a team with your existing lawyers in your jurisdiction or independently.

Some disputes have to be handled by the courts and under the law of the place where the other party to the dispute is based. We can assist in determining this and if the conclusion is that the dispute needs to be handled overseas then through our network of international connections we can put you in touch with the right overseas lawyer for the job. We can work as a team with the overseas lawyers to ensure you have all the information you need and an understanding of the options.

Sometimes, if you have a dispute with an overseas party it can still be handled under English law and in the English Courts. This requires advice about how the overseas party is served with any proceedings and, if you obtain a favourable result and the defendant’s assets are abroad, we can liaise with appropriate overseas lawyers to enforce the judgment or settlement agreement.
